COMMERCIAL TRANSACTIONS AND LITIGATION–
Over the past several years the firm has participated in negotiating and closing transactions from the standpoint of both the lender/investor as well as the business entity. The firm approaches each transaction by analyzing the client’s short tem and long term goals and objectives. Representative transactions include representing TransEd, Inc. as a sub-contractor in a 900 million dollar New York City Transit Authority contract to build subway cars; and representing Miami Ventures, Ltd., venture capital fund, in its investment in the first black-owned hotel on Miami Beach, Florida.
The firm also handles complex commercial litigation on behalf of both Plaintiffs and Defendants. Our representation extends beyond the traditional courtroom environment and includes defense of administrative proceedings related to Business Certifications in administrative proceedings, as well as administrative actions related to licensing and qualifications. Recently, Mr. Douthit represented the City of North Miami in litigation against Florida Power and Light seeking to invalidate the then existing franchise agreement authorizing Florida Power and Light to do business within the City. The result was a new franchise agreement which will provide the City with over 3.9 million dollars in additional revenue over the life of the agreement.
Our philosophy is to keep the client’s ultimate goal at the forefront of our litigation strategy. The scope of our representation extends from large corporate entities in defense of contract disputes, to Trustees in bankruptcy proceedings seeking to avoid fraudulent transfers, all the way to individuals defending themselves against Fortune 500 companies. In July of 2005, Mr. Douthit successfully defended ADF International, Inc., one of the world’s largest suppliers of steel and steel products in its successful defense of debarment proceedings brought by Miami-Dade County, Florida.
CORPORATE LAW–
As part of its Business Development practice, the firm has established a mechanism to provide a full array of legal services to businesses who do not have “in-house” legal counsel. By serving as outside “in-house” counsel, the firm provides businesses with the benefits of an “in-house” lawyer. The firm provides services such as attending corporate meetings, preparing resolutions of the board, drafting and negotiating contracts, representing the company in administrative hearings and prosecuting and defending lawsuits. Additionally, the firm provides general corporate representation to a variety of business, including corporate creation and structuring services.
CRIMINAL LAW–
With over 17 years of criminal defense experience, the firm has represented a number of defendant’s in high profile criminal cases. The firm takes seriously its obligation to provide a vigorous defense to our clients. As with all of our practice areas, the firm takes a hands on approach to our representation and works hard towards helping the client fully understand the array of options available to them and the ramifications of their choices.
The firm’s representation includes areas of criminal law from white collar criminal cases, officer and director criminal liability in the corporate setting to juvenile criminal defense. The firm employs active investigative, public relations and accounting teams to assist the legal team in uncovering all information which will assist in preparing a vigorous defense as well as ensuring that in the particularly high profile cases, there is a unified message to the information conveyed to the public.
JUVENILE DEPENDENCY AND DELINQUENCY.–
Douthit Law has an extensive practice representing parents and child in proceedings where the state has removed a child from the custody of their parents. Additionally, we have extensive experience in adoptions and long term custody agreements. We try to not only deal with the legal issues facing both the children and the parents, but provide a holistic, solution based approach to assist the client in dealing with the rapidly changing circumstances in their lives.
APPELLATE LAW
Mr. Douthit has over 25 recorded written opinions in jurisdictions extending from Massachusetts to Florida. He is widely considered as one of the leading experts in the area of Juvenile Dependency law, where he represented parents who have had there children removed by the State. In addition he has written opinions in matters ranging from procedural due process issues to complex commercial litigation.
GOVERNMENTAL RELATIONS AND LOBBYING
Douthit Law, LLC has extensive experience representing clients in the procurement and certification processes who are seeking business opportunities with state and local contracting authorities. This experience includes preparation of bids, certification packages and lobbying efforts after bid submission. We have also prepared and argued bid protests on behalf of clients whose initial bid was unsuccessful. We are proud of our track record in this area, particularly on behalf of small and medium business enterprises.
Douthit Law has represented a variety of clients in Administrative Proceedings ranging from certification with state and local authorities to debarment proceedings initiated by contracting authorities. Notably, we successfully represented ADF International, Inc., one of the world's largest steel framing manufacturers in proceeding related to Miami-Dade County's 200 million dollar Performing Arts Center Project.
PROBATE LAW
The firm has an active practice representing families as they deal with the loss of their loved ones. We also assist individuals in preparing for and planning the final distribution of their assets and for other important end of life decisions.
